Terms of Service

These Terms of Service ("Terms") govern your use of applications and services provided by Feedings LTD (Company No. 16795680) ("we", "our", or "us").

By using our services, you agree to these Terms. If you do not agree, do not use our services.

1. Acceptance of Terms

By accessing or using our applications, you agree to be bound by these Terms and our Privacy Policy. These Terms apply to all users, including anonymous users.

2. Description of Service

Feedings LTD provides RSS feed reader applications and related services across multiple platforms (iOS, Android, Microsoft Store).

3. User Accounts

3.1 Account Types

• Anonymous: No account required, full RSS features, ads with privacy choices, no backup
• Free Account: Full features with account, ads with privacy choices, 1 backup per week, local storage only
• Ad Free: Monthly subscription (£2.50/month) with no ads, all Free Account features. Cancellable at any time.
• Supporter: Monthly subscription (£5/month) with no ads, auto-backup, cloud sync, and enhanced features. Cancellable at any time.

You can upgrade or downgrade between subscription tiers at any time through your Apple App Store or Google Play Store account settings. Changes take effect immediately - see section 5.6 for details.

3.2 Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

3.3 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use and Prohibited Conduct

4.1 General Obligations

You agree to use our services in a lawful, respectful manner and in accordance with these Terms. You are solely responsible for your conduct and any content you submit, post, or share through our services.

4.2 Prohibited Conduct

You agree not to:

• Violate any applicable local, national, or international laws or regulations
• Infringe on intellectual property rights of others
• Transmit malicious code, viruses, or any other harmful software
• Attempt to gain unauthorised access to our systems, servers, or networks
• Use the service to spam, harass, threaten, or abuse others
• Scrape, harvest, or collect data without permission
• Reverse engineer, decompile, or disassemble our applications
• Interfere with or disrupt the integrity or performance of our services
• Attempt to circumvent any security measures or access restrictions
• Use automated systems (bots, scripts, crawlers) to access the service without authorisation
• Impersonate any person or entity, or misrepresent your affiliation

4.3 Harmful and Illegal Content

You must not use our services to store, transmit, share, or promote:

• Content that promotes hatred, violence, discrimination, or harm against individuals or groups based on race, ethnicity, religion, sexual orientation, disability, or any other protected characteristic
• Content that is threatening, abusive, defamatory, or obscene
• Content that exploits, harms, or endangers minors in any way
• Content that promotes terrorism, extremism, or radicalisation
• Content that facilitates or promotes illegal activities
• Fraudulent, deceptive, or misleading content
• Content that infringes upon the privacy or personal rights of others

4.4 Enforcement and Consequences

We reserve the right, at our sole discretion, to investigate any suspected violations of these Terms. If we determine that a violation has occurred, we may take any action we deem appropriate, including but not limited to:

• Issuing a warning to your account
• Temporary suspension of your account and access to services
• Permanent termination of your account without refund
• Removal of any content that violates these Terms
• Reporting illegal activities to the appropriate law enforcement authorities
• Pursuing legal action to recover any costs or damages

We may take these actions without prior notice where we reasonably believe:

• There is an immediate risk of harm to any person or entity
• Illegal activity is occurring or has occurred
• There is a threat to the security or integrity of our services
• Action is required to comply with applicable law or legal process

4.5 Reporting Violations

If you become aware of any violation of these Terms, please report it to us using the in-built support ticket actions, or at support@feedings.co.uk. We take all reports seriously and will investigate accordingly.

5. Subscription and Payments

5.1 Ad Free Tier

• Subscription fee: £2.50/month
• Payment processed through Apple App Store or Google Play Store
• Automatic monthly renewal unless cancelled
• Right to cancel at any time through your app store account settings
• Cancellation takes effect at the end of current billing period
• No charges after cancellation
• No access to payment card details (handled by Apple/Google)

Benefits include:

• Remove all advertisements
• All Free Account features

5.2 Supporter Tier

• Subscription fee: £5/month
• Payment processed through Apple App Store or Google Play Store
• Automatic monthly renewal unless cancelled
• Right to cancel at any time through your app store account settings
• Cancellation takes effect at the end of current billing period
• No charges after cancellation
• No access to payment card details (handled by Apple/Google)

Benefits include:

• Remove all advertisements
• Auto-backup (24-hour and weekly options)
• Full backup including Dings & Read Status
• Last 7 backups history for instant restore
• 20 manual cloud syncs per month

5.3 Cancellation

You may cancel your subscription at any time through your Apple App Store or Google Play Store account settings. Cancellation prevents future charges and takes effect at the end of the current billing period. You retain access to your subscription features until the current period expires.

5.4 Data Retention After Cancellation

Following cancellation of a paid subscription:

• Your account will revert to the Free Account tier
• Pro-tier data (including cloud backups, sync data, and premium features data) will be retained for 90 days
• After the 90-day retention period, pro-tier data will be permanently deleted
• Data associated with the Free Account tier will be retained unless you request deletion
• If you resubscribe within the 90-day period, your pro-tier data will be restored

5.5 Price Changes

We reserve the right to change subscription prices with 30 days notice to existing subscribers.

5.6 Your Rights Regarding Subscriptions

• Right to cancel at any time without penalty
• Right to upgrade or downgrade between tiers at any time (changes take effect immediately - see 5.7)
• Right to receive confirmation of cancellation
• Right to continue using paid features until end of current billing period (for cancellations)
• Right to resubscribe at any time
• No early termination fees

5.7 Upgrading and Downgrading

You can switch between Ad Free and Supporter tiers at any time through your app store account settings.

• Upgrades: Take effect immediately. You gain access to the new tier's features straight away.
• Downgrades: Take effect immediately. You lose access to higher-tier features straight away. Any remaining value from your current subscription is credited as additional time on your new, lower-priced plan.

Example: On android, if you downgrade from Supporter (£5/month) to Ad Free (£2.50/month) halfway through your billing cycle, you'll immediately switch to Ad Free features, and your remaining balance converts to approximately double the time on the Ad Free plan. On iOS, your downgrade will take place at the next billing date

6. Advertising (Free Tiers Only)

6.1 Ad Display

Anonymous and Free Account users will see advertisements served by Google AdMob. Ad Free and Supporter subscribers have no advertisements.

6.2 Consent and Privacy Choices

We use Google AdMob's consent management:

• Users in the EEA, UK, and Switzerland are presented with a consent form on first use
• Users in US states with privacy laws receive opt-out notices as required
• You can reset your consent/privacy choices at any time in app settings
• AdMob's privacy policy applies: https://policies.google.com/privacy

6.3 No Ad Clicking Obligations

You are not required to interact with advertisements. Ad revenue helps support development.

7. Content and Intellectual Property

7.1 Your Content

• You retain ownership of RSS feeds and content you add
• You grant us a license to store and sync your content across devices
• You are responsible for ensuring you have rights to access content

7.2 Our Intellectual Property

All content, features, and functionality of Feedings (including but not limited to software, code, applications, text, displays, images, video, audio, design, logos, user interface, and the selection and arrangement thereof) are owned by Feedings LTD, its licensors, or other providers of such material and are protected by United Kingdom and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

7.3 Trademarks

The following are trademarks or service marks of Feedings LTD:

• "FeeDings" and "Feedings"
• "Ding!", "ShareDings!" and "ShareDing!"
• "ShoutDing! & ShoutDings!"
• The Feedings logo and banner design
• "Add to Feedings" button and design
• Other Feedings graphics, logos, designs, page headers, button icons, scripts, and service names

You may not use these marks without our prior written permission. Use of these marks without authorization may constitute trademark infringement and unfair competition in violation of UK and international laws.

No part of our applications, website, or materials may be reproduced, distributed, transmitted, displayed, published, or broadcast without our prior written permission, except as permitted by UK copyright law.

7.5 License to Use Our Service

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install our application on your personal devices
• Access and use the service for your personal, non-commercial use

This license does not include any rights to:

• Resell or make commercial use of the service
• Collect and use product listings, descriptions, or prices
• Make derivative works or modify our intellectual property
• Download or copy account information for the benefit of another party
• Use data mining, robots, or similar data gathering tools
• Reverse engineer, decompile, or disassemble any part of our service
• Remove or modify any copyright, trademark, or proprietary notices

7.6 User-Generated Content (Themes)

When you upload custom themes to the Community Theme Exchange:

• You retain ownership of your theme designs
• You grant us a worldwide, non-exclusive, royalty-free license to display and distribute your themes within our service
• You grant other users the right to download and use your themes within the Feedings application
• You represent that your themes do not infringe on any third-party intellectual property rights
• We may remove themes that violate these Terms or infringe on rights of others

7.7 Copyright Infringement Claims

If you believe any content on our service infringes your copyright, please contact us at:

• A description of the copyrighted work you claim has been infringed
• A description of where the allegedly infringing material is located
• Your contact information
• A statement of good faith belief that the use is not authorized
• A statement that the information is accurate and you are authorized to act on behalf of the copyright owner
• Your physical or electronic signature

7.8 Proprietary Rights Notice

All rights not expressly granted in these Terms are reserved by Feedings LTD.

8. Service Availability

8.1 No Guarantee

We strive for high availability but do not guarantee uninterrupted service. We may suspend service for maintenance or updates.

8.2 Changes to Service

We may modify, suspend, or discontinue features at any time with reasonable notice.

9. Disclaimer of Warranties

Our services are provided "as is" without warranties of any kind, express or implied. We do not warrant that:

• The service will be error-free or uninterrupted
• Defects will be corrected
• The service is free of viruses or harmful components

10. Limitation of Liability

To the maximum extent permitted by law, Feedings LTD shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Any damages exceeding the amount paid to us in the past 12 months

11. Indemnification

You agree to indemnify and hold harmless Feedings LTD from any claims arising from your use of our services or violation of these Terms.

12. Third-Party Services

Our applications integrate with third-party services (app stores, Firebase, AdMob, etc.). Your use of these services is subject to their respective terms.

13. Data Protection

We process your data in accordance with our Privacy Policy and UK GDPR requirements.

14. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Changes to Terms

We may update these Terms from time to time. Continued use of our services after changes constitutes acceptance of the new Terms.

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
